TJS Webs (ABN: [Pending Registration]) ("TJS Webs", "we", "us", "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, hold, use, disclose and protect your personal information, and how you can access or correct it.
We handle personal information in accordance with the Privacy Act 1988 (Cth) (the "Privacy Act") and the 13 Australian Privacy Principles ("APPs") contained in that Act. By using our website (the "Site") or engaging our services, you consent to the collection, use and disclosure of your personal information as described in this policy.
1. About this policy
This policy applies to all personal information collected by TJS Webs through our Site, our online forms, our quote and checkout process, email and other communications, and in the course of providing website design, development, hosting and maintenance services.
"Personal information" means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not and whether recorded in a material form or not, as defined in the Privacy Act.
2. What personal information we collect
The types of personal information we may collect and hold include:
- Identity and contact details — your name, business name, email address and phone number.
- Project information — the contents of any project brief, quote request or enquiry you submit, including your website requirements, examples of sites you like, and descriptions of any logos, brand colours or assets you provide.
- Account information — if you create an account, the details you provide when registering and signing in.
- Payment information — when you purchase a service, payment is processed securely by our third-party payment provider (Stripe). We do not collect or store your full card number or card security details on our systems; we may receive limited transaction information such as confirmation of payment, the amount, and the package purchased.
- Technical and usage information — information collected automatically when you visit the Site, such as your IP address, browser type, device information, pages viewed and the date and time of access, including information stored locally in your browser (see "Cookies & website analytics" below).
- Any other information you choose to provide to us in your communications.
You do not have to provide your personal information to us. However, if you do not, we may be unable to provide you with a quote, process your purchase, or deliver our services.
3. How we collect personal information
We collect personal information in the following ways:
- Directly from you — when you complete a quote request, project brief or contact form, create an account, email or call us, or otherwise communicate with us.
- Through our checkout process — when you purchase a package, certain order details are recorded so we can begin work.
- Automatically — through cookies, local browser storage and similar technologies when you use the Site.
- From third parties — such as our payment provider (Stripe) confirming a completed transaction. Where it is reasonable and practicable to do so, we collect personal information directly from you rather than from a third party.
4. Why we collect, hold and use personal information
We collect, hold and use your personal information for purposes including:
- responding to your enquiries and providing quotes;
- processing your order and payment;
- designing, building, hosting and maintaining your website;
- communicating with you about your project and our services;
- issuing tax invoices and keeping financial records;
- providing customer support and handling complaints;
- improving and securing our Site and services; and
- complying with our legal obligations.
We will only use your personal information for the purpose for which it was collected, a directly related secondary purpose you would reasonably expect, or where you have consented or the use is otherwise permitted or required by law.
5. Cookies & website analytics
Our Site uses cookies and local browser storage to remember your preferences (for example, your cookie-consent choice) and to help us understand how the Site is used. Cookies are small data files stored on your device.
You can set your browser to refuse cookies or to alert you when cookies are being used. However, some parts of the Site may not function properly if you disable cookies. Where required, we will seek your consent before placing non-essential cookies.
6. Who we disclose personal information to
We do not sell your personal information. We may disclose your personal information to:
- Service providers who help us operate our business and Site, including our payment processor (Stripe), our form-handling provider (Formspree), and our website hosting, domain and infrastructure providers;
- Professional advisers such as accountants and legal advisers, where reasonably necessary;
- Government agencies, law enforcement or other parties where required or authorised by law; and
- Any other party with your consent.
Where we engage service providers, we take reasonable steps to ensure they handle your personal information consistently with the Privacy Act.
7. Overseas disclosure
Some of the third-party service providers we use store or process data on servers located outside Australia. In particular:
- Stripe (payment processing) — may process data in the United States and other countries;
- Formspree (form submissions) — may process data in the United States; and
- Content delivery and font providers used by the Site (for example, providers that deliver fonts and scripts) — may process limited technical data such as your IP address overseas.
Where we disclose personal information to overseas recipients, we take reasonable steps to ensure the recipient handles it in a manner consistent with the Australian Privacy Principles, in accordance with APP 8.
8. How we keep your information secure
We take reasonable steps to protect your personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include using reputable third-party providers, restricting access to information, and using secure (SSL/TLS encrypted) connections for our Site and checkout.
However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.
9. How long we keep your information
We retain personal information only for as long as it is needed for the purposes described in this policy, or as required to meet our legal, accounting and record-keeping obligations (for example, tax records must generally be kept for a number of years). When personal information is no longer required, we take reasonable steps to securely destroy or de-identify it.
10. Accessing and correcting your personal information
You have the right to request access to the personal information we hold about you, and to ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading, in accordance with APP 12 and APP 13.
To make a request, please contact us using the details below. We will respond within a reasonable period. There is no fee for making a request, although we may charge a reasonable fee for giving access in certain circumstances. If we refuse access or correction, we will tell you why in writing and how you can complain.
11. Direct marketing
We may occasionally send you information about our services that we think may interest you. We will only do so where permitted under the Privacy Act and the Spam Act 2003 (Cth). Every marketing message will include a simple way to opt out, and you can ask us at any time to stop sending you marketing communications by contacting us. We do not use sensitive information for direct marketing.
12. Data breaches
We comply with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act. If we become aware of a data breach that is likely to result in serious harm to any individual whose personal information is involved, we will notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by law.
13. Complaints
If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please contact us first using the details below so we can investigate and respond. We will acknowledge your complaint and aim to resolve it within a reasonable time.
If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC):
